Terms of Service

1. Acceptance

By creating an account or using the ArchWyse platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not create an account or use the Platform.

2. Eligibility

You must be at least 18 years old and legally capable of forming a binding contract under Indian law to use the Platform. The Platform is intended for professional use — specifically, interview preparation and hiring assessments.

3. Account Responsibilities

You are solely responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us promptly at support@archwyse.com of any unauthorized access

You may not share your account credentials with others or allow third parties to access your account.

4. Candidate Use

As a candidate, you may use ArchWyse to practice High-Level Design interview skills. When taking an organization-administered assessment (OA), you acknowledge and agree that:

• Your audio responses, transcripts, diagrams, and AI-generated evaluations will be shared with the inviting organization
• Your session will be monitored by AI proctoring technology for assessment integrity purposes
• You will not attempt to share, publish, or reproduce assessment questions
• You will complete the assessment honestly without using unauthorized assistance
• You will receive only one attempt per assessment invite; once submitted, results are final

5. Organization Use

As an organization, you agree that:

• You have obtained a lawful basis under the DPDP Act, 2023 to process your candidates' personal data through this Platform (e.g., legitimate interest in hiring, or explicit consent from candidates)
• You will use assessment results only for legitimate, lawful hiring purposes
• AI-generated evaluations are one input among many — you will not use them as the sole basis for hiring or rejection decisions
• You will not use the Platform to harass, discriminate against, or unlawfully profile candidates
• You are responsible for the accuracy of job descriptions and assessments you create
• You will only invite candidates who have a reasonable expectation of receiving such an assessment from you

6. AI-Generated Content Disclaimer

All evaluations, scores, and feedback generated by ArchWyse are produced by AI models (including OpenAI GPT) and are assistive tools only. They may contain inaccuracies, reflect model biases, or misinterpret candidate responses.

ArchWyse makes no warranty as to the accuracy or completeness of AI-generated evaluations. ArchWyse is not liable for any hiring decision, offer, or rejection made based on these evaluations.

7. Intellectual Property

All platform code, design, branding, and non-user-submitted content belong to ArchWyse. You may not copy, reverse-engineer, scrape, or redistribute any part of the Platform without our prior written permission.

You retain ownership of content you submit (e.g., your interview responses, diagrams). By submitting content, you grant ArchWyse a limited, non-exclusive license to process and store it for service delivery purposes.

8. Payments and Refunds

All subscription and top-up payments are processed in USD via Stripe and are non-refundable once processed, except where required by applicable law.

Subscription plans grant access for 30 days from activation. Unused invite credits do not roll over between plan cycles unless you upgrade mid-cycle, in which case unused credits from the current cycle carry forward.

ArchWyse reserves the right to change pricing at any time, with at least 15 days' notice to active subscribers.

9. Prohibited Conduct

You may not:

• Use the Platform for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse-engineer, decompile, or scrape the Platform or its API
• Use bots, scripts, or automated tools to take assessments or interact with the Platform
• Upload or transmit malicious code, viruses, or harmful content
• Impersonate another person or entity

10. Termination

We may suspend or terminate your account immediately, without notice, if you violate these Terms or engage in conduct harmful to users or the Platform.

You may delete your account at any time via Profile → Delete Account. Termination does not entitle you to a refund of any payments already made. Payment records will be retained for 7 years as required by Indian financial regulations.

11. Limitation of Liability

To the maximum extent permitted by applicable Indian law, ArchWyse's total liability for any claim arising out of or related to these Terms or your use of the Platform shall not exceed the total amount paid by you to ArchWyse in the 3 months preceding the event giving rise to the claim.

ArchWyse shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, data, or business opportunity, even if advised of the possibility of such damages.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of AI evaluations, or uninterrupted availability.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email of material changes at least 15 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
